Before you start
Please read these terms before using SmartBooster. Using the app means you accept the current version of these terms and of its privacy policy. The app is made by GOLARIX LLC doo (“we,” “the owner”), and you can reach us at apps@golarix.info.
What you’re agreeing to
These terms are an end-user license agreement between you and GOLARIX LLC doo covering this iPhone app, and installing the app means you accept them. Please also stick to the privacy policy and to any further terms we post on this site. Using the app counts as agreeing to all of this, and we can revise these terms whenever we like without telling you first. Your App Store download also comes with Apple’s standard EULA.
Your license
The app is licensed to you, not sold. We give you a limited license to run one copy on a single device for your own non-commercial use. It’s non-exclusive, and you can’t transfer it or sublicense it to anyone. It lasts as long as you follow these terms. You get no title to or ownership of the app, and nothing here amounts to selling you rights in it.
What you can’t do
Unless we’ve authorized you to distribute the app, please don’t:
- make or hand out copies, or move the app from one device to another;
- decompile, disassemble or reverse engineer it, translate it, or build it into other software;
- use it for commercial purposes;
- change it in any way or make derivative works from it;
- rent, lease, resell, sublicense, assign or otherwise pass on the app or this license.
Trying any of these is void and has no effect.
Who owns the app
The intellectual property in the app stays with GOLARIX LLC doo. None of it passes to you, and you gain no rights in the app. Please leave our copyright, trademark and other ownership notices in place on anything that comes with the app or is downloaded alongside it.
No warranty
We provide the app “as is,” with no warranty of any kind. We make no express or implied promises, including on merchantability, on suiting a particular purpose, or on not infringing anyone else’s rights. The whole risk of how well the app works sits with you, and we don’t promise its features will meet your needs or that it will run without errors.
Limits on our liability
We won’t be responsible for incidental, special or consequential damage that comes from owning, opening, using or a fault in the app. That includes property damage, lost goodwill and phone or computer breakdowns and, as far as the law allows, personal injury, lost profits or punitive damages, whatever the claim is based on (contract, tort including negligence, strict liability or anything else) and even if we were warned such damage could happen.
Some states and countries don’t allow certain limits like these, so they apply as fully as the law where you are permits, and not where a law that can’t be overridden forbids a particular part. Depending on where you live, you may have further rights. Apart from what the law requires, our total liability for all damage will never be more than what you actually paid to use the app.
Privacy
The app’s privacy policy lives on this site and inside the app. Please read it all the way through.
Covering us
You agree to compensate, defend and protect GOLARIX LLC doo against any damage, loss or cost that comes, directly or indirectly, from what you do or fail to do while using the app under these terms, or from you breaking them.
When these terms change
We may change or replace these terms whenever we decide to. Changes will go up on this page, so please check back now and then.
Free use, trials and Premium
There are three ways to use the app:
- Free version. Some features, with no time limit.
- Free trial. Every feature, at no charge, for a limited time.
- Premium. A paid subscription that opens up all content, but only while it’s active. You can buy it inside the app wherever the app marketplace allows.
Premium comes in weekly, monthly and yearly plans. Here a week means 7 calendar days, a month 30 and a year 365. A plan renews on its own and keeps charging the payment method you chose until you cancel, so cancel before the next renewal if you don’t want to be charged again. A yearly plan is paid upfront in one go and renews every year. Refunds aren’t available for part of a period. On iPhone, cancel by going to Settings: open Settings, tap your name, then Subscriptions.
Sales through the App Store or our iPhone app are final, and we don’t give refunds. Your purchase falls under Apple’s own payment policy, which may not offer refunds either.
We may lengthen or renew a trial during special promotions, at our discretion. If a trial ends and you haven’t bought a subscription, your access to the app and its content may stop before any payment arrives, and data you added during the trial may be deleted unless you subscribe to the same features. The agreement itself rolls over for further periods unless we receive written notice ending it at least 10 days before the current term runs out.
Ending these terms
These terms stay in force until you or we end them. You can end them anytime by no longer using the app. We can end them at any moment, without notice and for any reason we choose, and cut off your access. Even then, the parts about intellectual property, indemnity, disclaimers, limits on liability and governing law keep applying.
Settling disagreements
- Before going to court, both sides must try to settle a dispute through a written claim. This step is binding.
- Claims must be handed over in person, or sent as registered post with proof of delivery, to the address where the other side is located. Ours is GOLARIX LLC doo, Obilićev venac 18 (2. sprat, lokal 5.11), 11102 Beograd – Stari Grad, Serbia. Claims sent any other way don’t count.
- The side receiving a claim has 21 working days from receipt to consider it.
- If that doesn’t settle things, the dispute goes to court under the applicable law.
Which law applies
These terms are governed by, and read under, Serbian law, since Serbia is where GOLARIX LLC doo is registered. Anything these terms don’t cover follows Serbian law, and any dispute is handled the way Serbian law sets out. Wherever these terms talk about legislation, they mean the laws of Serbia.
