PulseSense Terms and Conditions

The rules for using PulseSense: Heart Tracker, an app by GOLARIX LLC doo.

The basics

These terms cover PulseSense: Heart Tracker, an iPhone app by GOLARIX LLC doo. Downloading or using PulseSense means you’re OK with them. If you’re not, please don’t use it.

Your license

PulseSense is licensed to you, not sold. Your download comes with Apple’s standard EULA, and these terms add the details that are specific to PulseSense. Use it on an Apple device you own or control, for your own non-commercial purposes, the way the App Store’s Usage Rules allow.

Play nice

  • Don’t copy, change, resell or pass the app around.
  • Don’t pick it apart or dodge paid features, unless the law specifically lets you.
  • Don’t use it for anything illegal or to hurt anyone.
  • Don’t mess with the services it depends on.

Wellness, not medicine

PulseSense is for general wellness. Its camera pulse readings are estimates, and blood sugar and blood pressure values are numbers you type in yourself. It doesn’t give medical advice, a diagnosis or treatment. Please read our Medical Disclaimer, and talk to a doctor about anything health-related.

Subscriptions

PulseSense may offer subscriptions that renew automatically. Apple takes care of payment and billing through the App Store, so card details never reach us. You’ll see the price and how often it bills before you buy.

  • A plan keeps renewing until you switch auto-renew off, ideally a full day ahead of your renewal date.
  • If you don’t cancel, a free trial turns into a paid plan when it runs out.
  • Deleting the app won’t cancel the subscription.

How to cancel

  1. Open Settings, tap your name, then Subscriptions.
  2. Choose PulseSense.
  3. Tap Cancel Subscription.

Paid features keep working until the stretch you’ve already paid for runs out.

Refunds

Every payment goes through Apple, so refund decisions are Apple’s. Ask at reportaproblem.apple.com with your Apple ID. We can’t send money back ourselves, but write to us if something went wrong and we’ll help where we can.

Your readings and data

How PulseSense handles the readings and notes you save is explained in its privacy policy.

Who owns what

The app, including its design, words, graphics and code, belongs to GOLARIX LLC doo or the people who license them to us. Using PulseSense doesn’t make any of that yours.

No extra promises

As far as the law lets us, PulseSense comes “as is” and “as available,” with no extra warranties, and we can’t promise it will always be available or bug-free. Your legal rights as a consumer stay exactly where they are.

How far our responsibility goes

As far as the law lets us, GOLARIX LLC doo isn’t on the hook for indirect or knock-on losses, lost data or lost profits that come from using PulseSense, and the most we’d owe on any claim is what you actually paid to use it. None of this limits what the law won’t let us limit, such as responsibility for fraud, or for death or injury our negligence causes.

Where Apple fits in

This agreement is between you and GOLARIX LLC doo; Apple isn’t part of it. Apple doesn’t answer for PulseSense or anything in it and doesn’t have to support it. Under the standard EULA, Apple and its subsidiaries can enforce its terms as third-party beneficiaries.

Which law applies

Serbian law governs these terms, and the relevant court in Belgrade handles any dispute. If you’re a consumer, the mandatory consumer laws where you live still protect you, and you can bring a claim at home.

Updates to these terms

From time to time we’ll refresh these terms; the date up top shows which version you’re reading. Keep using PulseSense after an update, and the new version applies.
